Welcome to DailyDrop (Virtual Supermarkets Ltd). By using our website or mobile applications ("Platform"), you agree to the following terms and conditions. Please read them carefully before accessing or using our services.
1. Acceptance of Terms
By accessing or using our Platform, you agree to be bound by these Terms & Conditions, our Privacy Policy, and any additional policies we may provide. If you do not agree to these terms, you will not be able to use the Platform.
2. Eligibility
To use our services, you must be at least 13 years old and capable of forming a binding legal contract. If you are under 13, you may use the Platform only under the supervision of a parent or guardian.
3. Products & Services
We offer natural, organic, and sustainable products, including milk & milk products, fruits & vegetables, bakery items, eggs, fish, poultry, meat & seafood, cereals, cooking oils, rice, flour, pulses, salt & sugar, pasta & noodles, ketchups, spreads, sauces, dressings, herbs, spices, dry fruits, seeds, health foods, baby products, biscuits & snacks, chocolates & sweets, tea, coffee, water, soda, juices, health & energy drinks, detergents, cleaners, disposables, fresheners & repellents, cosmetics & beauty products, wellness products, pet products, alcohol, cigarettes & lighters, kitchen & dining, lifestyle products, stationery, toys, games and other products. All products are subject to availability and may be changed or discontinued at our discretion without prior notice.
4. Orders & Payments
• Orders can be placed through the website or mobile app. Prices are listed in KES and may include applicable taxes.
• We accept payments through secure third-party gateways.
• DailyDrop reserves the right to cancel or refuse any order at our discretion, for reasons including but not limited to product unavailability, quality control issues, or unforeseen supply chain disruptions.
• DailyDrop reserves the right to forfeit any balance or credit deposited by the user that remains unused for a continuous period of twelve (12) months.
• DailyDrop reserves the right not to refund any amount, full or partial, paid into the wallet. The amount paid will only be used for purchasing the products.
• In case of missed payments, we reserve the right to suspend or terminate your service.
5. Subscription Plans
• We offer subscription-based delivery services. By enrolling, you provide affirmative consent for automatically recurring payments.
• You may manage or cancel your subscription from your account settings.
• Subscription Cancellation Window: Cancellations must be made at least 24 hours prior to your next scheduled delivery to avoid being charged for the upcoming delivery.
• Pause/Skip Delivery: Many subscription plans offer the option to pause or skip upcoming deliveries; details are available in your account settings.
• Modification of Subscription: You can modify your subscription (e.g., changing products, delivery frequency, or quantity) through your account settings.
• Pricing Changes for Subscriptions: Subscription Fees are subject to change. We will notify you by changing the price on the website and mobile app. Your continued use of the subscription after the price change constitutes your agreement to the new price.
• Simplified Cancellation: The cancellation process is designed to be as easy as signing up, accessible directly through your account settings.
6. Delivery
We deliver to select areas within Nairobi. You can check delivery availability at checkout or by entering your delivery location on the website/mobile app. Delivery timelines are estimated and not guaranteed. Delays may occur due to weather, traffic, logistics constraints, or other unforeseen issues.
7. Intellectual Property
All content on the Platform, including logos, images, text, videos, graphics, and software, is the property of DailyDropand protected by copyright and trademark laws. You may not copy, reproduce, distribute, or use any content without our express written permission.
8. User Conduct
You agree not to:
• Violate any applicable laws or regulations.
• Use the Platform to transmit spam, viruses, or harmful content.
• Attempt to gain unauthorized access to our systems or other users' accounts.
• Post or transmit any obscene, violent, defamatory, or otherwise objectionable content.
• Engage in any activity that interferes with or disrupts the Platform's functionality.
9. Limitation of Liability
To the maximum extent permitted by law, DailyDrop shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, or any loss of data, use, goodwill, or other intangible losses, resulting from:
• Your access to or use of, or inability to access or use, the Platform or our products.
• Any conduct or content of any third party on the Platform.
• Any content obtained from the Platform.
• Unauthorized access, use, or alteration of your transmissions or content.
We do not guarantee the correctness, availability, usefulness, reliability, validity, accuracy, completeness, timeliness, correct sequencing, or suitability of the Content on the Sites , and the Company shall not be liable for any errors or deficiencies in any Content on the Sites, or for any action or inaction taken by you in reliance on any Content. Your use of any Content from the Sites is entirely at your own risk.
10. Indemnification
You agree to indemnify, defend, and hold harmless DailyDrop, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees that such parties may incur as a result of or arising from your (or anyone using your account's) violation of these Terms & Conditions or your use of the Platform.
11. Force Majeure
DailyDrop shall not be liable for any failure or delay in performance due to unforeseen events beyond our reasonable control, including but not limited to acts of God, war, riots, civil unrest, fire, flood, severe weather conditions, epidemics, pandemics, widespread transportation disruptions, significant labor disputes, or supply chain failures. In such events, our obligations will be suspended for the duration of the event.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of Republic of Kenya. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Nairobi, Kenya.
13. Updates to Terms
We may update these Terms at any time. Changes will be posted on this page with a new "Effective Date". Your continued use of the Platform after updates means you accept the updated Terms.
